Decrees: Article 1 Under Title III of Book I of the Code ofConstruction and housing (regulations), it is added a chapter IV, entitled "Diagnostic techniques" composed of two sections and includes articles R. 134-1 to R. 134-9 read as follows: "Chapter IV" Technical diagnostics "Section 1 Diagnosis of energy performance" Art. R. 134-1. - This section applies to any building or part of building shell and core, with the following exceptions: a) temporary buildings with a planned duration of use not exceeding two years, "b) separate buildings whose surface gross within the meaning of Article R. 112-2 of the Town Planning Code is less than 50 square meters "c) buildings for agricultural, commercial and industrial power, other than premises used for residential purposes, which require only a small amount of energy forthe heating, hot water or cooling; "d) All buildings used as places of worship; e) The historic monuments or listed in the inventory under the Code of heritage." Art. R. 134-2. - The energy performance diagnostics includes: a) The relevant characteristics of the building or part of the building and a description of its equipment for heating, hot water, cooling, ventilation, and in some types of buildings, lighting integrated local showing for each category of equipment, conditions of use and management that impact on energy consumption, "b) The indication for each category of equipment, the annual amount of energy consumed or estimated by a conventional method of calculationand an assessment of annual expenditures resulting from this consumption, "c) The assessment of the amount of emissions of greenhouse gases linked to the annual energy consumed or estimated," d) The assessment of the amount of energy produced from renewable sources by equipment permanently installed and used in the building or part of the building in question; e) The classification of the building or part of a building pursuant to a reference scale established according to the annual energy consumed or estimated, for heating, hot water and cooling, per surface area of the building or part of the building, "f) The classification of the building or part of the building pursuant to a reference scale established based on the amount of emissions of greenhouse gases, forthe heating, hot water and cooling, per surface area of a building or part of a building, "g) recommendations to improve the energy performance of a building or part of a building, accompanied by an evaluation of their cost and their effectiveness; 'h) Where the building or part of the building is equipped with a boiler of a power greater than or equal to 20 kilowatts, the report of inspection of the boiler. Art. R. 134-3. - When the diagnosis of energy performance is on a building or part of a building that boasts a collective heating, cooling or hot water, the owner of the collective system, its agent or trustee condominiums provide the person requesting the diagnosis and the expense of the latter: "a) The quantityannual energy consumption for the building or part of a building by the collective system, "b) The calculation or the procedures leading to the determination of this amount from the total amount of energy consumed by the device class;" c) A description of community facilities for heating, cooling or hot water production and their management style. Article 2 The provisions of the last paragraph of Article R. 134-2 are applicable only after the entry into force of the decrees referred to in 2 ° of II of Article L. 224-1 of the Environmental Code.
